Any purchase of a product present in the online store of the website www.serviderma.com requires the consultation and acceptance of these terms and conditions of sale. The purchase from this website and the fact of placing any order, implies that you have read and accepted these terms and conditions of sale.

Preamble

The purpose of these general conditions is to define the rights and obligations of both parties, within the framework of the Internet sale of products offered by the seller to the consumer.

Order confirmation

The current information will be followed by an e-mail to the e-mail indicated by the buyer, after the order notification.

Confirmation en proof of payment

Records stored in TechDerma's company systems under appropriate security conditions are considered as proof of communications, orders and payments between both parties.

The storage of purchase orders and invoices, made in a reliable and durable manner can be created as proof of purchase.

Products information

All efforts have been made to ensure the accuracy of the information on www.serviderma.com or its suppliers, however are not responsible for any consequences, incidents, damages resulting from electronic transmission or the accuracy of the information transmitted, even if TechDerma S.L.U. is aware of the possibility of such damages. The names and brands of products and manufacturers are used solely for identification purposes. All photos, descriptions and prices are not contractual.

Period of validity of offers and prices

Special offers, promotions or discounts are valid until the indicated data or until the end of the indicated numbers of stocks. As well as the prices indicated at the time of consultation of the website- 

Shipping costs and delivery times

The products are delivered to the address indicated by the buyer in the order form, and only in the geographical destinations specified in the delivery methods.

All products are shipped in perfect condition. The customer must notify the logistics company (or the letter carrier) the slightest trace of impact (holes, traces of crushing, breakage, etc) on the package, and, where appropriate, must refuse the package. An identical product will be sent free of charge.


The exchange of a product declared, after, and damaged during transport, without any reservation that has been issued upon receipt of the package, can not be taken into account.

As with any shipment, it is possible to suffer a delay or that the product is lost. In such a case, the logistics company will be contacted to initiate an investigation. Every effort will be made, for as long as necessary, to find the package. If necessary, the merchant will be reimbursed by the logistics company and a new identical package will be delivered free of charge.

For our part, we decline any responsibility on delivery times caused by the logistics company, especially in case of loss of products, weather or strikes.

Delivery problems by the logistics company

The consumer must send TECHDERMA S.L.U. the same day of delivery or as a last deadline the first working day after delivery, any kind of complaint due to a delivery error and / or non-conformity of the goods in kind or quality, with respect to the information provided on the order form.

At the end of this period, any claim will be rejected. The presentation of this claim to TECHDERMA S.L.U. may be addressed to Avda. Ventura Gassol, 13 bajos (08901) Hospitalet de Llobregat, BARCELONA.


The consumer must send a copy of the letter to Avda. Ventura Gassol, 13 bajos (08901) Hospitalet de Llobregat, Barcelona. Without this, no changes will be made.

Error in delivery

The consumer must send to TechDerma S.L.U. the same day of delivery or the first working day after delivery, any claim due to a delivery error and/or non-conformity of the goods in kind or quality, with respect to the information provided in the order form.

At the end of this period, any claim will be rejected. The presentation of this claim to TechDerma S.L.U. may be addressed to Avda. Ventura Gassol, 13 bajos (08901) Hospitalet de Llobregat, BarcelonaAny claim made according to the rules mentioned above and after the deadlines indicated, will not be considered and TechDerma S.L.U. will not be liable with respect to consumers.


In case of error in delivery or an exchange, any product for exchange or refund must be returned to TechDerma S.L.U. with all the elements of the order and in its original packaging, in perfect condition, to Avda. Ventura Gassol, 13 bajos (08901) Hospitalet de Llobregat, Barcelona.

Shipping costs will be borne by TechDerma S.L.U. unless it is shown that the product does not correspond to the original declaration made by the consumer, so that the change is made correctly.

Products' Warranty

The provisions of these conditions can not deprive the consumer of the legal warranty which requires that the professional seller must guarantee against any kind of defect of the product sold.

The consumer is explicitly informed that TechDerma S.L.U. is not the manufacturer of the products presented on www.serviderma.com so TechDerma S.L.U. is not responsible for defective products. Consequently, in case of damage to a person or product defect, only the responsibility of the manufacturer will be requested by the consumer, with respect to the information on the product packaging.


The warranty period is one year (1 year). Excluded from this warranty, all products repaired or modified by the customer or by any other company other than the suppliers selected by TECHDERMA S.L.U. are excluded.

Force Majeurce Causes 

None of the Parties shall be liable for the total or partial non-performance or delay in the performance of its obligations under this contract caused by external causes beyond its control. Force Majeure shall be deemed to include, without limitation: war, riots, insurrection, severe disruptions in Internet security, technical failures, unauthorized access and/or intrusions in the servers of the Website, strikes of any kind and telephone or computer failures.


If either party mentions a Force Majeure Event, it shall notify the other party within ten business days of the occurrence or imminent occurrence of such event.

The parties agree to communicate with each other in a timely manner to jointly determine the terms and conditions for filling an order, should a Force Majeure Event occur.


After one (1) month of interruption due to a Force Majeure Event, TechDerma S.L.U. may decide to cancel the order(s), in which case TechDerma S.L.U. will reimburse the Buyer, if applicable.

Severability

If one or more provisions of these General Conditions of Sale is deemed or declared invalid according to law, regulation or following an unappealable judgment issued by a court with jurisdiction, the remaining provisions shall retain their absolute scope and force.

No waiver

If a party does not indicate that is unable to perform one(s) of the obligation(s) listed in these general terms and conditions, it is bound to perform such obligation(s)

Aplicable Law

The present conditions shall be governed by Spanish law, which shall be applicable in all matters not provided for in this contract regarding interpretation, validity and execution.

In case of dispute or claim, the consumer will be addressed primarily to TechDerma S.L.U. to find an amicable solution.

Confidentiality and Data Protection

In compliance with the provisions of Law 15/1999 of 13 December on the Protection of Personal Data, personal data provided by the Buyer will be part of the file of customers of the Seller, whose purposes are the maintenance of the contractual relationship, control and management of sales and their corresponding collections. The Seller will treat such data with the utmost confidentiality, and undertakes not to use them for a purpose other than that for which they have been collected, as well as to keep them with the appropriate measures to ensure their security and prevent their alteration, loss, treatment or unauthorized access.


The Seller undertakes to maintain professional secrecy with respect to the aforementioned personal data, even after the termination of the contractual relationship.

The Buyer authorizes the Seller to keep its data for a period of five years after the completion of the contractual performance.

The Buyer has the possibility of exercising the rights of access, rectification, cancellation and opposition by sending a written communication to the attention of TECHDERMA S.L.U. or through the website, section "Your Account".

Regulation of disputes 

Any order placed through the online store www.serviderma.com is with the customer's agreement, without limitation, to the conditions of sale of TechDerma SLU. The present conditions of sale on line are submitted to the Spanish Law.


In case of dispute, jurisdiction is assigned to the competent courts in Hospitalet de Llobregat, as TechDerma S.L.U. headquarters despite plurality of defendants or call in warranty.

PRICES 

The prices presented in ServiDerma do not include VAT, which will be charged on the invoice, according to current regulations.


SHIPPING

ServiDerma offers several types of shipping depending on the costumer's needs. 

  • Standard shipment of material: Applicable to all kinds of products up to 20kg, in weight and a maximum volume of 150cm. (eight + lenght + widht)  
  • Customized shipment of furnitures:
  • Cost: Free for orders over 100,00€ without VAT, in lower orders the amount of shipping costs is 7,00€.


       Standard: Delivery at street level.

  • Cost: Free for orders over 300,00€ without VAT.

       Plus: Delivery within the customer¡s domicile. 

  • Cost: 250,00€

       Total: Delivery at the customer's address with unpacking and assembly. 

  • Cost: 350,00€


Each shipment is duly insured until your inquiry. Please check the number of packages and their condition upon receipt. If you find any anomaly, please note it on the delivery note. The carrier is responsible for the number of packages and their condition.


To report an incident in transport, you must inform us by phone +34 935 338 338 338 or by email to info@serviderma.com, indicating the order number and the problem. Once we receive the incident we will try to solve it in the best way and in the shortest time possible.

Conditions valid for Peninsula (including Portugal) and Balearic Islands.


Shipments to the Canary Island, Ceuta and Melilla 

These orders are exempt from VAT and considered export. The customer is responsible for the local taxes and fees that may apply in each case.

For transport costs:

  • You should contact us through pedidos@techderma.com to determine the shipping costs.
  • In case of making a direct purchase on the web we will contact the customer to inform and determine the shipping costs.


Each shipment is properly insured until your inquiry. Please check the number of packages and their condition upon receipt. If you find any anomaly, please note it on the delivery note. The carrier is responsible for the number of packages and their condition.

Delivery time

Any order is processed and shipped immediately, except in the case of stock shortage. In this case, if the stock cannot be quickly reestablished, more than one shipment will be made, however, there will be no cost for the customer, since the additional costs will be paid by TechDerma. The approximate delivery time will be one or two working days, except for clinical furniture, equipment, the aforementioned stock-outs and possible setbacks and delays with transport.

An order will be considered delivered when the delivery note is signed by the customer. It is in the 24 hours following the reception of the order, when the customer must verify the products and expose the objections that could exist.


In the event that a product is not available in a period exceeding 4 days, the customer will be informed of the delivery time of that product, if it is very high will be offered another similar. Likewise, the customer will have the possibility of:

  1. Request the order without the indicated product (in case of having paid for it, the amount corresponding to the product will be refunded).
  2. Accept the replacement product (in this case the difference will have to be paid).
  3. Wait to receive the order when the product is available.


Domicile

All orders will be delivered free of charge. To facilitate the delivery by our carrier the customer can inform us of the desired delivery times, being the responsibility of the carrier to comply with them. In case of bulky shipments the price only includes standard transport to the address at street level. In case the customer wants a personalized delivery TechDerma also offers this service, you can make the transport Plus (delivery within the customer's home) and Total transport (delivery within the customer's home with unpacking and assembly).


Returns

According to the provisions of the Royal Legislative Decree 1/2007, of November 16, 2007, you as a customer have a period of fourteen days from receipt of the goods ordered.

All goods must be returned in their original packaging, in perfect condition, unused and protected so as not to receive any damage with seals or adhesive transport tapes. Otherwise ServiDerma reserves the right to refuse the return.


After the period of fourteen days from the date of receipt, returns will only be accepted with the prior approval of TechDerma SL, otherwise the return will be refused and resent. The returns originated for reasons of our responsibility, will be paid in full, being the postage and expenses incurred at our expense.

Once the goods have been received and checked that they are in perfect conditions, the refund will be processed if so indicated. The transport expenses originated by the return will be paid by the customer.

Payments via bank transfer for returns will have a maximum period of 30 days for administrative procedures, although we try not to take more than 7 days.


Return Conditions

Returns of the following products will not be accepted, as established by Law 47/2002 of December 19, 2002, amending Law 7/1996 of January 15, 1996, on the Regulation of Retail Trade, for the transposition into Spanish law of Directive 97/7/EC on distance contracts, and for the adaptation of the Law to various Community Directives.


  • Products subject to fluctuations of financial market coefficients that the seller cannot control.
  • Products made to measure according to the customer's specifications or clearly personalized, specifically assembled according to a design specified in a configuration, or which, due to their nature, cannot be returned or may deteriorate, lose physical or hygienic properties or expire rapidly.
